This Privacy Policy (this "Policy") is a binding legal agreement between Liberty Oilfield Services LLC, a Delaware limited liability company ("we", "us", or "our") and you ("you" and "your"). This Policy governs our usage and disclosure of information collected from you when you register for our electronic communications system via the Sandtracker application (the "System"). By registering for the System, you consent to the data practices described in this Policy. If you do not agree with the terms of this Policy, you can deactivate your account in the System by uninstalling the application. We may modify this Policy from time to time in our sole discretion. Any modifications to this Policy will be posted on our website or sent to you by email. Unless you send us written notice that you object to the changes, you consent to the changes.
We collect personal information you voluntarily provide us, which may include your name, precise geolocation data, and contact information including your email address and phone number (collectively, "Personal Information"). Our servers may also collect technical and other information that does not identify you personally, like information about your computer hardware and software and whether emails or links have been opened or visited ("Technical Information"). We may use and share Technical Information, which does not identify you personally, in any way we deem appropriate.
We collect precise geolocation data from your device while you are available for hauling engagements or have a load in progress, even if you are not directly interacting with the System. We may collect and process information about the location of your device. We use location data to track load locations and manage loads, as well as to tailor our Services for you, like validating and facilitating load arrival at facilities, and assigning loads closer to you.
We do not sell, rent or lease your Personal Information. We only use and share your Personal Information as set forth in this Policy. We may use your Personal Information: (i) to fulfill the purpose for which you submitted it, such as to respond to your requests, sign you up for certain communications, or process and fulfill your orders; (ii) to protect the security or integrity of our systems and investigate any suspected breaches thereto; or (iii) to comply in our reasonable discretion with legal proceedings or applicable law. We may share Personal Information: (i) in connection with a court order, subpoena, government investigation, or as otherwise required by law, rule or regulation; (ii) with our affiliates or in the event of a corporate sale, merger, acquisition, or similar event; (iii) with third-party service providers who use it on our behalf, including payment processors, marketing partners, and support resources. All the categories of personal data mentioned above exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties under any circumstances. However, we may share your data with trusted service providers who assist us in operating our SMS program, provided they agree to keep your data confidential and use it solely for the purpose of providing services on our behalf. If at any time you wish to opt-out of communication notifications, please uninstall the application from your mobile device. You have the right to access, correct, or delete your personal information at any time.
Our communications and websites may contain links to third-party websites (each, a "Third-Party Site"). We provide these links only as a convenience. We do not control or operate Third-Party Sites and we do not endorse their contents. We are not liable for any information, products, advertisements, content, services or software accessible through any Third-Party Sites. Third-Party Sites are subject to website and privacy policies that we do not control; please review such policies closely before using any Third-Party Site.
We use commercially reasonable measure designed to help protect your Personal Information from unauthorized access, use or disclosure. However, no internet transmission can be guaranteed to be 100% secure, and if you submit any Personal Information to us you accept the inherent risks in doing so, including without limitation the risks of interception, unauthorized access, corruption, or deletion of your data.
